Our lawyer Júlia Vituli took part in an article published in E-Investidor, which dealt with the Tax Reform’s proposal to change the collection of Real Estate Transfer Tax (ITBI) when the registration is updated for the deed of the property purchase contract.

According to the expert, this change could lead to legal disputes in the future, as the time of the ITBI taxable event has always been a matter of doubt between municipalities and taxpayers. “The proposed change is not clear about the moment of the taxable event, which could be when the act or onerous transfer of the property is signed. This creates subjectivity and could lead to disputes and legal challenges,” he says.
