Our lawyer Thiago Braga took part in an article published in the magazine Consultor Jurídico (ConJur), which dealt with a decision by Carf (the Tax Appeals Administration Council) to deny the Federal Revenue Service’s request for diligence and to grant the appeal to dismiss the allegation that Rede Globo resorted to hiring professionals as legal entities in order to reduce the tax burden. According to the tax authorities, the company signed numerous contracts for services and the assignment of rights to use images and voices in order to pay employees who were improperly characterized as legal entities and thus reduce the tax burden levied on formal employment relationships.

The expert commented that the ruling indicates a change in Carf’s understanding of the issue. “The case is relevant because, despite this legislation and the STF’s position, Carf used to judge the matter unfavorably to taxpayers, with the exception of a case judged this year in favor of Rede D’or, but with some particularities involving doctors.”
